Since Gershwin died July 11, 1937, I do believe that he's now out of copyright in the EU. If there are any Gershwin scores published in Europe (unlikely?) they'd be great to use since (I believe) they'd likely be PD in the US also (per shorter of publication location copyright/use location copyright).
